Ankeny, IA Public Conduct: Outdoor Smoking Restrictions (2026)

Section 41.15, Smoking and Use of Electronic Smoking Devices Prohibited, defines 'City Facilities' broadly: every City-controlled property, enclosed or not, from work areas and conference rooms to any public or private recreational area such as fairgrounds, athletic fields, City parks and trails, parklets, plazas, skate parks, swimming pools, picnic tables and grassy areas. 'Smoking' is defined to include inhaling, exhaling, burning or carrying any lighted or heated cigar, cigarette, pipe, hookah or marijuana product, plus use of any electronic smoking device such as a vape pen, e-cigarette or e-hookah.

The operative rule bans Smoking and tobacco use in all City facilities at all times, and separately bars anyone from smoking, using, selling or distributing a Tobacco Product at or on City Facilities; the section states expressly that the ban on parks, trails and recreational areas applies regardless of whether signage is posted. The City is still required to post 'No Smoking' and 'No Vaping' signs, or the international symbols, at entrances to City buildings, parks and other applicable areas, and those signs must comply with Iowa Code § 142D.6.

The one carve-out in the text is for private property not owned or controlled by the City, which the section does not reach. A violation is a municipal infraction, not a criminal charge, capped at $50 for a first offense and $100 for any repeat offense.
