Baldwin Park, CA Public Conduct: Outdoor Smoking Restrictions (2026)

17 makes it unlawful to smoke in six specific outdoor and public settings: any elevator, any city-owned premises, any public park, any service area, any dining area, or within 20 feet of any entrance to, exit from or open window of a building open to the public. The code defines PUBLIC PARK broadly to include not just parkland but any public sidewalk adjacent to it, and names examples including Morgan Park, Barnes Park, Hilda Solis Park, Walnut Creek Nature Park, and the Baldwin Park Teen Center and Skate Park.

CITY-OWNED PREMISES covers any building or site the city owns or leases and occupies for a municipal function, such as City Hall and the City Yard, and likewise sweeps in the whole site and every structure on it. DINING AREA reaches outdoor patio and bar seating at any restaurant regardless of whether it sits in a residential or non-residential zone, so a sidewalk cafe table is covered even off a commercial strip. SERVICE AREA is defined to include farmers' markets, bus stops, the Metrolink Station, and lines at ATMs, vending machines or information kiosks, extending the ban well beyond parks and government buildings into everyday public queuing spots.

17(B) separately bars discarding cigarette or cigar butts anywhere smoking is prohibited under the subchapter, except into a designated waste disposal container, adding a litter violation on top of the smoking prohibition itself. 18 requires the city to post signs marking no-smoking areas at city-owned premises and public parks, with wording, size, color and placement set by the Chief Executive Officer or a designee. 030 and was amended by Ordinance 1232 in 2004 and Ordinance 1299 in 2007.
