Outdoor smoking in Colonie is governed primarily by the New York Clean Indoor Air Act, Public Health Law Article 13-E (Β§Β§1399-n through 1399-x), which has been progressively expanded since 2003 to cover specific outdoor areas. New York's outdoor-smoking framework operates through three layers. (1) NY Public Health Law Article 13-E (Clean Indoor Air Act): Β§Β§1399-n through 1399-x prohibit smoking in essentially all enclosed indoor workplaces and have been amended to extend to specified outdoor areas. PHL Β§1399-o(6), as amended by L.2017 c.91, prohibits smoking within 100 feet of the entrances, exits, and outdoor areas of public and non-public elementary and secondary schools - a rule that directly applies to dozens of school sites within the Town of Colonie (North Colonie Central School District, South Colonie Central School District, Shaker, Sand Creek, Forts Ferry, Lisha Kill, and others). PHL Β§1399-q prohibits smoking on hospital grounds and on grounds of certain residential health-care facilities. The 2017 amendments also extended the indoor-restaurant prohibition to certain enclosed and partially-enclosed outdoor dining areas. (2) Vaping/e-cigarettes: L.2017 c.402 amended Article 13-E to include vaping and e-cigarette use within the same restrictions. The Tobacco 21 statute (PHL Β§1399-cc, eff Nov 2019) sets the minimum tobacco/vape purchase age at 21. (3) Albany County: The Albany County Department of Health enforces Article 13-E within the County and has separately adopted county-level smoke-free-outdoor-park policies and outdoor-event policies that apply to County parks and facilities; some Colonie events held on County property fall under those rules. (4) Town of Colonie park rules: the Colonie Parks and Recreation Department's park rules typically prohibit smoking on Town playgrounds and within designated tobacco-free zones. The Town Code at ecode360.com/CO0290 does not establish a separate townwide outdoor-smoking prohibition beyond these layered state and county rules. Private-property owners (shopping centers along Wolf Road, Crossgates Mall in the adjacent Town of Guilderland, Colonie Center) may impose stricter smoke-free policies enforceable as trespass.
Violations of PHL Article 13-E are enforceable by the Albany County Department of Health under PHL Β§1399-v with civil penalties up to $1,000 per violation for individuals and up to $2,000 for the first violation by a place of employment (higher for repeat). Specific violations: smoking within 100 feet of a school entrance under Β§1399-o(6) is enforceable by Albany County DOH with the same civil-penalty framework; the offending school may also enforce the prohibition through campus security and refer to local police for trespass. Tobacco 21 violations (sale to a person under 21) carry tiered civil penalties up to $1,000 per offense under PHL Β§1399-ee. Albany County park policy violations are enforceable as Park Code citations through the County Sheriff. Town park violations are Town Code violations in Colonie Town Court. Vaping-product violations are enforced through the same framework following the 2017 amendment.
