Section 8-218 exempts private residences (unless used for childcare, adult day care or health care), private clubs, licensed retail tobacco stores, religious ceremonies where smoking is ritual, medical research facilities, and performers smoking as part of a theatrical performance.
Violations & Fines
Every violation is a public nuisance and a civil infraction under Section 8-220: fines run up to $100.00 for a first offense, up to $200.00 for a second, and up to $500.00 for each additional violation, with each day of noncompliance a separate infraction. Three or more infractions at one location within six months is deemed a business nuisance, and the city may also seek an injunction or license suspension.
