Cook County DPH Tobacco Program enforces in unincorporated areas and roughly 120 contracting suburbs; Chicago, Evanston, and other independent health departments enforce within their own boundaries. Many Cook suburbs added outdoor smoking bans for parks, beaches, train platforms, and outdoor dining, including Oak Park's beach ban and Evanston's lakefront rule. Tobacco-21 also applies countywide under both state and federal law.
Smoke Free Illinois Act violations carry fines from $100 to $250 for individuals and up to $2,500 for repeat business owners under 410 ILCS 82/35. Local park or beach smoking fines run $50 to $500 per offense.
