Full Breakdown

Sec. 12-153 prohibits smoking in any 'public place' or 'common area' and within 25 feet in any direction of one. The definitions in Sec. 12-152 sweep in outdoor venues most cities leave uncovered: public ball fields, pools and splash parks, arenas, skate parks, park pavilions and shelters, outdoor sports courts and playgrounds, plus restaurants, bars, libraries and business lobbies. 'Smoking' covers e-cigarettes and vape pens as well as combustible tobacco. Property owners and managers must post 'No Smoking' signage and inform patrons, though the absence of a sign is not a defense to a citation.

Violations & Fines

A violation is a misdemeanor infraction under Title 1, Chapter 9, punishable per incident; each occurrence is charged as a separate infraction.

Frequently Asked Questions

Can I vape in a Greeley city park?
No. Sec. 12-153's ban covers 'smoking,' which Sec. 12-152 defines to include electronic smoking devices, and it applies at ball fields, pools, playgrounds and park pavilions, plus 25 feet around them.
Does the ban apply on restaurant or bar patios?
Yes if the patio is part of a 'public place' as defined in Sec. 12-152, which lists restaurants and taverns; the 25-foot buffer applies to those areas as well.
