Smoking in Kennewick is controlled mainly by the Washington Clean Indoor Air Act (RCW 70.160), which bans smoking in indoor public places and workplaces and within 25 feet of doors, windows, and air intakes. Kennewick park rules and KMC Title 10 add some outdoor restrictions.
RCW 70.160 β Washington's Smoking in Public Places statute, enacted by Initiative 901 in 2005 β bars smoking in all indoor public places and places of employment, including restaurants, bars, casinos, bowling alleys, and private clubs, and within a presumptive 25-foot perimeter of doorways, opening windows, and ventilation intakes that serve enclosed places where smoking is prohibited (RCW 70.160.075). Enforcement falls to the Benton-Franklin Health District and local police. RCW 70.345 (Vapor Products Act) extends similar restrictions to e-cigarettes and vapor products. Washington school grounds are statewide smoke-free under RCW 28A.210.310. Kennewick adds outdoor regulation primarily through KMC Title 10 (Peace, Safety, Morals) and park rules adopted under KMC 10.08, which can prohibit smoking on specific city park or trail facilities; Columbia Park is jointly managed with the U.S. Army Corps of Engineers, and federal park rules add further restrictions on the south shoreline. RCW 70.160 does not contain an express preemption clause; cities may adopt stricter local rules, but a statewide outdoor ban on private property is not currently in effect.
RCW 70.160.090 makes violating the smoking-in-public-places ban a Class 3 civil infraction (currently $50 default penalty per RCW 7.80.120). Businesses that knowingly permit smoking can face additional Class 3 infractions and Department of Health enforcement. Park-rules violations are processed under KMC Title 10 with citations into Benton County District Court.
