Kingsport, TN Public Conduct: Outdoor Smoking Restrictions (2026)

Sec. 62-213 defines a playground as an indoor or outdoor facility that is intended for recreation of children and owned by the City of Kingsport, and defines smoking as the burning of a tobacco product, hemp product, or any other drug or substance. Use of a vapor product is not smoking under that section. Sec. 62-212 goes further at the city's aquatic center, where smoking is prohibited anywhere on the grounds, including inside the building, the outdoor swimming areas, sidewalks, roads and parking areas, under authority cited to Public Chapter No.

847 of the Public Acts of the 109th General Assembly. Sec. 62-211 authorizes the city manager to promulgate rules for smoking on city-owned property controlled by the Board of Mayor and Aldermen, including designated smoking areas outside city-owned facilities. A person violating those rules, once a copy is available in the office of the city recorder, the office of the city manager and the public library, is guilty of an offense, and an employee who fails to follow them faces corrective action up to termination.

Vapor products are covered separately by Sec. 62-233, which makes it an offense to use an electronic smoking device in any building owned, leased or controlled by the city or within twenty-five feet of any entrance or exit, or a greater posted distance; in any place owned, leased or controlled by the city where state law prohibits smoking tobacco; and in any other city area, including an outdoor area, posted with a sign that use is prohibited.
