Lincoln County, NC Public Conduct: Outdoor Smoking Restrictions (2026)

08 of the parks and recreation chapter states plainly that in a park, it is unlawful for any person to smoke, vape, or use any tobacco products in all Lincoln County owned, leased, or operated parks and recreation facilities. 02 to include all Lincoln County owned or operated real property designated and designed as a public park, along with foot paths, trails, and recreational facilities, and it names the Beatty's Ford swim beach as one covered site. Because the ban applies to the whole park rather than to a single structure, it reaches open-air picnic areas, trails and athletic fields, not just enclosed recreation buildings.

15: park staff authorized by the Board of Commissioners and local law enforcement can issue citations for violations, and the county can add any state fine or penalty available under the North Carolina General Statutes on top of the county's own $50 assessment. 15(A), based on how serious the conduct was, independent of the monetary fine. The rule does not extend to sidewalks, streets or private property outside a designated county park, and it does not reach the Town of Lincolnton's own parks, which that municipality regulates under its own code.
