Marietta, GA Public Conduct: Outdoor Smoking Restrictions (2026)

Section 10-4-210, first adopted by Ordinance No. 7348 on July 8, 2009 and most recently amended by Ordinance No. 8138 on March 11, 2020, bans using, inhaling, exhaling, burning, or carrying any lighted cigar, cigarette, pipe, electronic cigarette, weed, plant, or other combustible substance anywhere in the city's indoor and outdoor parks and recreational facilities. The list of covered locations in Subsection A is specific: restrooms, athletic fields, aquatic areas, parks, hiking, walking and biking trails, playgrounds, off-leash dog park areas, and spectator and concession areas.

The only relief valve is a designated smoking area set up by the parks, recreation and facilities director, and even that has to sit at least 50 feet from any playing field, playground, or program site. Subsection B carves out the City Club public golf course and the Marietta Golf Center entirely. Subsection C extends the ban beyond park boundaries into a mapped downtown City of Marietta No Smoking District, covering its streets, alleys, and sidewalks, so smoking is barred on a swath of public right-of-way even outside any park gate.

The section carries no fine of its own, so a violation is enforced under Section 10-4-160's general penalty for the General Offenses chapter: a fine of not more than $500 or imprisonment of not more than six months.
