Marietta, GA Public Conduct: Public Alcohol Use (2026)

Code § 8-8-2-163(B) makes it unlawful for any person to drink or attempt to drink any alcoholic beverage from a can, bottle, glass, cup, or container on the public streets, sidewalks, trails, parks, rights-of-way, and public or private parking lots within the city, except for the clear-plastic-cup exception carved out for the approved entertainment district described in §§ 8-8-2-161 through -164. Even inside that district, containers are capped at 12 fluid ounces, only one drink per person may be carried out of a licensed premises at a time, glass containers may not leave the premises unless the customer is seated at a permitted outdoor dining restaurant, and consumption is barred on any parcel used as a trail, public park, church, day care, school or the adjoining sidewalk, in any alley other than McNeel Alley, and in any parking lot.

Separately, § 10-4-070 prohibits drinking alcoholic beverages on the premises of any city-owned or -operated park, building, or recreation center, or on the streets and sidewalks leading to those premises, and bars drinking inside a parked vehicle on lots or streets adjacent to city parks and recreation centers; violations of that prohibition can be waived only by city council action for a bona fide charitable or civic cause, or for city-sanctioned events at named venues like the City Club, the Marietta Conference Center and Resort, and Brumby Hall and Gardens. 5-inch sign at the door warning that leaving the permitted area with an open container is a violation subject to citation or fine.
