Full Breakdown
A of the Revere Municipal Code states no person shall smoke in any public park, or other public place under the control of the city of Revere. B defines smoking for purposes of the subsection to include inhaling, exhaling, burning or carrying any lighted cigar, cigarette, pipe, or other lighted or vaporized substance in any manner or form, including marijuana used for medical or recreational purposes, so vaping and cannabis smoking are both covered along with tobacco. 110 explains the rationale, citing the health risk of secondhand smoke in outdoor areas and the city's goal, carried out through the parks and recreation department and the police department, of keeping recreation areas safe, clean and healthy for residents, particularly children.
B requires that all public parks be posted as Alcohol, Drug, Tobacco, and Weapon Free Zones with signage installed at each park. c. 112 itself does not print a separate penalty clause.
Violations & Fines
Section 9.08.112 does not print its own penalty amount, but it was enacted as part of ordinance 18-233 alongside 9.08.116, which authorizes enforcement of park violations by noncriminal disposition under G.L. c. 40, Section 21D or by filing a criminal complaint, with a $300 fine per offense for the weapons provision in that same ordinance.
