Revere, MA Public Conduct: Public Marijuana Use (2026)

Chapter 9.17, Section 9.17.010.A of the Revere Municipal Code prohibits smoking, ingesting or otherwise using or consuming marihuana or tetrahydrocannabinol, as defined in G.L. c. 94C, Section 1, while in or upon any street, sidewalk, public way, footway, passageway, stairs, bridge, park, playground, beach, recreation area, boat landing, public building, schoolhouse, school grounds, cemetery, parking lot, or any area owned by or under the control of the city, or on a bus or other common-carrier conveyance, or in any place accessible to the public. Subsection B requires that marijuana or THC seized in a violation be safely held until final adjudication and then destroyed under G.L. c.

94C, Section 47A. Subsection C sets the fine at $300 for each offense, enforceable by the board of health or its agents or by any police officer, either through criminal indictment or complaint under G.L. c. 40, Section 21, or by noncriminal disposition under G.L. c. 40, Section 21D, or both; the section states any penalty imposed is in addition to the civil penalty available under G.L. c. 94C, Section 32L, and that all fines collected go to the city. Subsection D adds a further $300 fine for a person who, informed that an officer intends to cite them for possessing one ounce or less of marijuana under G.L. c.

94C, Section 32L or this ordinance, refuses to give a true name and address or gives a false one, and another $300 fine for failing to show positive identification to the police department within 24 hours of being cited. The ordinance was adopted as C.O. 09-006 on April 6, 2009, well before statewide legalization, and covers use in public regardless of possession amount.
