SDMC Β§43.1003 makes San Diego one of the strongest US smoke-free cities, banning smoking on beaches, in parks, at outdoor dining, transit stops, and within 25 feet of any building entrance, including cannabis and vape products.
Under SDMC Β§43.1003 and the 2022 amendments, smoking and vaping are prohibited on all city beaches, in city parks, on the boardwalk, at outdoor dining areas, transit stops, and within 25 feet of any building entrance, operable window, or air intake. The ban covers tobacco, cannabis, electronic smoking devices, and hookah. California Government Code Β§7596 prohibits smoking in state buildings; AB-2308 (2024) bans smoking on state beaches and parks, layering with city rules. Violations are infractions, citable by SDPD, park rangers, and lifeguards. Cannabis consumption in public is separately barred by Health and Safety Code Β§11362.3.
Infractions under SDMC Β§43.1003 carry fines starting at $100 for a first offense, rising to $200 second and $500 third within one year. Repeated violations on city property may trigger trespass warnings and exclusion orders.
