Full Breakdown

80 prohibits smoking, including vaping through any 'Electronic Smoking Device,' in a Public Place or Place of Employment except in a designated area, and separately bans it in or on any Outdoor/Patio Dining Area or within 20 feet of that area's perimeter. 54. No-smoking signs must be posted conspicuously, with outdoor dining areas required to post a sign at every point of entry. Owners, operators and managers must comply and cannot serve anyone smoking in a posted no-smoking area; the City Manager can grant a business a narrow exemption for unique circumstances. 80 ban wherever parkland is involved.

Violations & Fines

Chapter 8.80 does not carry its own criminal penalty section, so violations are enforced through the City's general nuisance and citation authority, and an owner or manager who lets patrons smoke in a posted no-smoking area is itself a violation of § 8.80.080. Smoking within 100 feet of a park boundary under § 9.04.050(e) is enforced under Chapter 1.12 and can result in a citation, warning, or an order under § 9.04.100 to leave the park for the remainder of the day.
