Oceanside, CA Public Conduct: Outdoor Smoking Restrictions (2026)

City Code Chapter 10A prohibits smoking, defined to include lit cigarettes, cigars, pipes and electronic cigarettes, across a specific list of outdoor public spaces. 3(b) bans smoking anywhere within a public park's boundaries, including sidewalks, picnic areas, ball fields, play areas and tot lots, though smoking stays legal in public parking lots, on streets adjacent to parks, and on public golf courses. Chewing tobacco or discarding its waste is separately barred within 50 feet of any playground or tot lot sandbox area in a park.

3(d) extends the ban across the entire Civic Center Plaza Complex bounded by Coast Highway, Civic Center Drive, Nevada Street and Pier View Way. 3(e) covers all public beaches, including picnic areas and tot lots, while still permitting smoking in adjacent beach parking lots, on sidewalks and stairways, and along adjacent public streets. 3(f) bans smoking on the entire Oceanside Pier and its ramps, and throughout the defined Pier Plaza Area, running from the strand east to N. Pacific Street and from Mission Ave north to the Oceanside Beach Community Center, including the Junior Seau Pier Amphitheater.

3(g) and (h) prohibit smoking in unenclosed dining areas citywide and within a 20-foot reasonable distance of them on a public right-of-way or sidewalk, except while actively passing through to another destination. 3(i) adds a 25-foot no-smoking buffer around the Pier View Way Underpass. 6(d) requires anyone with legal or de facto control of an unenclosed dining area to post a No Smoking sign at every point of ingress. 3(j).
