Chapter 8.12's stated purpose is to prohibit smoking of tobacco or any other weed or plant in public places, places of employment, and controlled locations because it endangers health and causes material annoyance (Section 8.12.010). Section 8.12.030(A) states the core prohibition: no person shall smoke in a public place, a controlled location, or place of employment, except in a designated smoking area under Section 8.12.040, and 8.12.030(B) bars placing ashtrays or smoking receptacles in prohibited areas. The definition of 'public place' in Section 8.12.020(C) is not limited to indoor space: subsection (C)(2) reaches any unenclosed dining area of an eating establishment plus a 'Reasonable Distance,' which Section 8.12.020(H) fixes at no less than twenty feet in any direction from the smoking-prohibited boundary.

Subsection (C)(3) separately designates the entire City Hall Complex, Wave Water Park, the Public Library, and their adjacent City-owned parking lots as public places where smoking is banned except in a City Manager-designated outdoor smoking area, with the boundary defined as the interior edge of the public sidewalk or a boundary fence where no street abuts. Section 8.12.040 carves out narrow exceptions: private residences (except during licensed family day care hours), up to 40 percent of hotel guestrooms if management approves, employer-designated employee breakrooms meeting Labor Code Section 6404.5(d)(13), truck cabs with no nonsmoking employees present, approved patient smoking areas in long-term health facilities, theatrical and medical-research sites where smoking is integral to the activity, and the designated consumption area of a temporary cannabis event permitted under Chapter 12.13 or 18.76.
