Oceanside, CA Public Conduct: Public Marijuana Use (2026)

Chapter 10A of the Oceanside City Code was adopted to serve the public health, safety and welfare by prohibiting the smoking of tobacco or any other weed or plant in public areas and places of employment except in designated smoking areas (Sec. 1). The operative ban in Sec. 3(a) makes it unlawful to smoke in a public place or place of employment outside designated smoking areas, and the code's definition of "smoke" in Sec. 2(a) covers "the carry of a lighted cigarette of any kind, lighted pipe or lighted cigar," language that is not limited to tobacco products and so reaches a marijuana cigarette or pipe.

Beyond the general public-place ban, Sec. 3 layers on absolute, no-exception smoking bans in specific city-controlled areas regardless of any designated smoking area: all public parks including sidewalks, picnic areas, ball fields, play areas and tot lots (subsection (b)); the Civic Center Plaza Complex bounded by Coast Highway, Civic Center Drive, Nevada Street and Pier View Way (subsection (d)); public beaches including picnic areas and tot lots (subsection (e)); the Oceanside Pier, its ramps, and the Pier Plaza Area (subsection (f)); unenclosed dining areas and within 20 feet of them on a public right-of-way or sidewalk (subsections (g)-(h)); and the Pier View Way Underpass and within 25 feet of it (subsection (i)).

Smoking remains permitted in public parking lots, on public streets adjacent to parks or beaches, and on public golf courses. Enforcement runs through Chapter 1 of the city code (Sec. 3(j)), the city's general penalty provisions, which the Oceanside Police Department applies through citation.
