Oceanside, CA Public Conduct: Public Alcohol Use (2026)

Sec. 40(a) prohibits consuming "any beer, wine or other alcoholic beverage" in a list of specific public locations: any sidewalk, alley, street or highway; any publicly designated parking lot; the Municipal Pier except the restaurant and lounge at its western end; Oceanside Beach; The Strand and adjacent walkways; the Pier Plaza Area; and eleven named city parks, including Tyson Street Park, Strand Beach Park, Rotary Park, Santa Fe Park, Buddy Todd Park, Libby Lake Park, Balderrama Park, Buccaneer Park, John Landes Park, Cesar Chavez Park and Fireside Park, plus any Oceanside Community Development Commission property unless the commission has formally consented.

5% or more alcohol by volume. Subsection (c) allows the city's special events committee or city council to waive the ban under Chapter 30A, which is how permitted festivals and beer gardens operate at the pier plaza and beachfront parks. The ordinance dates to Ord. No. 76-19 (1976) and has been amended repeatedly through Ord. No. 08-OR0333-1 (May 21, 2008) to add newly opened parks to the list.
