Summary

No person shall consume any alcoholic beverage on any public beach or beach which is open to the public; or on any street, sidewalk, alley, highway, public parking lot or bluff-top whether improved or unimproved adjacent to such beach... This section shall not apply to the consumption of alcoholic beverages on any private residential property, including hotels or motels, located in any area specified in this section, or on the South Carlsbad State Beach Campgrounds.

020 makes it unlawful to consume alcohol on any public beach open to the public, or on any street, sidewalk, alley, highway, public parking lot or bluff-top adjacent to such a beach, though the section does not apply to private residential property including hotels or motels in those areas, or to the South Carlsbad State Beach Campgrounds. 040 separately bars possessing an open, unsealed or partially emptied alcohol container, or consuming alcohol, in city-owned streets, sidewalks, alleys, parking lots and open space within the Village Barrio Zone's VC, VG, HOSP, FC, PT and VBO districts, plus Rotary Park, Holiday Park and Pine Avenue Community Park; unlawful possession is an infraction and unlawful consumption may be charged as a misdemeanor.
The City Manager may waive these prohibitions for a special event or park-use permit, and the section does not apply to a permitted sidewalk or curb cafe or to possession for recycling. 08.
Violations & Fines
Unlawful possession of an open container under Section 8.44.040 is charged as an infraction; unlawful consumption under the same section may be charged as a misdemeanor. Violating the beach-drinking ban in Section 8.44.020 or the near-liquor-store open-container ban in Section 8.44.030 is punished as an infraction under Chapter 1.08. Citywide, a misdemeanor carries up to a $1,000 fine and up to six months in jail.
