Under San Jose Municipal Code § 9.44.030, smoking is prohibited citywide in every city park, a term defined to include sidewalks, trails, pathways and strips in or around park facilities, plus all outdoor dining areas (including sidewalk cafes), any outdoor service line or queue, and any area within 25 feet horizontally or vertically of a doorway, window, or air intake at a city-owned community center or library. Enclosed workplaces and public/common areas of apartments and mobilehome parks are separately banned under the same section. Narrow exceptions cover private residences, licensed tobacco retailers, designated airport smoking rooms, and outdoor areas of city golf courses more than 25 feet from any building opening (§ 9.44.040). Owners and operators must post 'No Smoking' signage (§ 9.44.060).
