" The code defines "tobacco product" broadly as "any product made or derived from tobacco that is intended for human use, including any component, part, or accessory of a tobacco product," expressly naming cigarettes, cigarette tobacco, e-cigarettes, cigars, roll-your-own tobacco and smokeless tobacco. Because the ban covers both smoking and tobacco use as separate prohibited acts, vaping and chewing tobacco are barred the same as lighting a cigarette; there is no exception for outdoor picnic areas, trails, athletic fields or parking lots within a park's boundaries.

The current version of Sec. 42-43 was enacted by Ord. No. 2014-06-13 on June 3, 2014, which repealed and replaced a 2007-era provision (Ord. No. 2007-02-16) that had addressed only underage smoking. The parks chapter sits alongside other park-conduct rules in Chapter 42, including bans on alcohol (Sec. 42-38) and open fires outside designated grills (Sec. 42-42). The ordinance applies citywide to every park operated by the city's recreation and parks department; it does not extend to sidewalks, streets or private property outside a park's boundary, so a smoker on a public sidewalk adjacent to a park is not covered by this section.
