Santa Clarita, CA Public Conduct: Outdoor Smoking Restrictions (2026)

Section 9.50.055 provides that, except as otherwise provided, "it is unlawful for any person to smoke in any park in the City of Santa Clarita." Section 9.50.020 defines "park" expansively as "every park, roadside rest, golf course, riding and hiking trail, open space easement to which the public has an unrestricted right of access and use for park or recreation purposes, and every other recreation facility owned, managed, or controlled by the City and under the jurisdiction of the Director," meaning the smoking ban is not confined to playground-style parks.

This park-specific ban was added by Ordinance 06-9 in 2006 and layered onto the older Section 9.50.050 ban on smoking in enclosed public places, which by definition covers indoor venues rather than open-air spaces. Because Section 9.50.020 defines "public place" as an "enclosed area," an uncovered outdoor patio at a restaurant is not automatically swept into the Chapter 9.50 ban the way a city park is; the parks provision is the chapter's only unambiguous open-air smoking prohibition. Signage duties under Section 9.50.060 apply to enclosed areas regulated by the chapter, and the chapter's smoking definition (Section 9.50.020) again includes tobacco, weed, plant, or any other combustible substance, so the park ban covers marijuana smoking as well as tobacco and vaping.
