Santa Rosa, CA Public Conduct: Outdoor Smoking Restrictions (2026)

050(A) of the Santa Rosa City Code lists the unenclosed nonresidential places where smoking is banned: parks and recreational areas (smoking allowed only in areas the City Manager designates), outdoor dining areas, Old Courthouse Square, the Comstock Mall pedestrian ways, Jeju Way, the downtown transit mall between B Street and Santa Rosa Avenue, the Westside Transfer Station, and outdoor service areas generally. Subsection (B) extends the prohibition a minimum of 25 feet from any of those smoke-free areas, so a smoker cannot simply step to the edge of a park or plaza; the only exception is someone actively passing through without entering or lingering in the restricted zone.

Subsection (C) lets the owner or operator of a privately owned unenclosed dining area apply for a one-day special event permit allowing tobacco use as an integral part of the event. 060 separately bans smoking in and on all City-owned vehicles, enclosed City property, and unenclosed City-owned property, again subject to a 25-foot buffer from streets, alleys, and abutting sidewalks. 150: any violation of the chapter is an infraction, and owners, operators, and employers who control regulated premises must also comply or face the same penalties for allowing smoking to occur. 160 additionally declares secondhand smoke a nuisance that any private citizen may sue to abate, separate from the City's own citation authority.
