Santa Rosa, CA Public Conduct: Public Marijuana Use (2026)

Chapter 9-20's definitions section is explicit: "smoking" means igniting, inhaling, exhaling, burning, vaping, operating, or carrying any lighted cigar, cigarette, pipe, hookah, electronic smoking device, tobacco product, or any other combustible substance including marijuana. That single definition pulls cannabis into every prohibition in the chapter. 050(A) bans smoking in parks and recreational areas, dining areas, Old Courthouse Square, the Comstock Mall pedestrian ways, Jeju Way, the downtown transit mall, the Westside Transfer Station, and outdoor service areas, unless the City Manager has authorized a designated smoking area at least 25 feet from doorways, windows, playgrounds, and other recreation improvements.

060 goes further on land the City itself owns or operates: smoking is barred in every City vehicle, every enclosed City-owned area, and every unenclosed area the City owns, again except in a City Manager-designated smoking area; the ban does not reach streets, alleys, and abutting sidewalks, though even there a smoker must stay at least 25 feet from any area where smoking is prohibited unless just passing through. 150: any peace officer may cite a violation, and it is unlawful both for a person to smoke in a restricted area and for whoever controls the premises to allow it.
