Sebastian County, AR Public Conduct: Outdoor Smoking Restrictions (2026)

08, adopted by Ord. 2015-17 on November 18, 2015, prohibits smoking or tobacco use, including e-cigarettes and vapor products, on all county-owned and operated property. The ordinance defines SMOKING/TOBACCO USE broadly to cover the lighting or possession of a lit cigarette, cigar or pipe, plus smokeless tobacco, e-cigarettes and vapor products. The ban applies inside and around the New Courts Facility, the Old Sebastian County Courthouse and the Greenwood Courthouse, including their elevators, stairways, hallways, restrooms, break rooms, concessions and courtrooms, and extends to all county parks and recreational facilities and to any present or future county-owned or operated building, office or ground within Sebastian County.

The County Judge must post signs in a conspicuous place in courthouses, office buildings and recreational facilities, and additional signs and notices must be placed on doors and in access areas so the no-smoking policy is clearly visible to visitors and employees. The rule reaches outdoor grounds, not just interior spaces, so a patio or parking area attached to a county building or park falls under the ban the same as an office hallway does. 08 does not extend to private property or to municipally owned property inside cities such as Fort Smith or Greenwood, which set their own smoking rules separately.
