VICIOUS ANIMAL. (1) Any animal that inflicts unprovoked bites or attacks human beings, canines, livestock, or poultry shall be considered a VICIOUS ANIMAL. At the discretion of an animal control officer or a police officer, any animal that approaches an individual in such a way as to place that individual in reasonable fear of unprovoked injury or attack whether it occurs upon streets, sidewalks, public grounds, or private property may be considered a VICIOUS ANIMAL. ... (3) Appeal of determination. Any person who has received notice that his or her animal has been deemed a vicious or aggressive animal may appeal such decision to the Sebastian County Judge. The appeal must be in writing and made within five business days of the day the notice was provided in accordance with this division.

The finding must be in writing and served on the owner either by certified mail or personally. Once served, the owner has five business days to file a written appeal with the Sebastian County Judge, who must schedule and hold a hearing within five business days of receiving it; the Judge's ruling is the county's final decision, though a further appeal can go to a court of competent jurisdiction. If the owner does not appeal, the initial classification becomes final automatically. 15(4) bars the owner from letting the animal go unconfined on the property or leave the property unless it is securely leashed and humanely muzzled or otherwise securely restrained. 17(B) until an officer makes that determination.

Sebastian County Code § 93.99(B) makes any violation of §§ 93.15 et seq. a Class A misdemeanor, with each day of continuing violation counted as a separate offense.
