030 gives the Fire Marshal discretionary authority to designate places where it is lawful or unlawful to light, ignite, or set fire to tobacco, a cigarette, pipe, cigar, or other smoking device, whether on private property with the owner's permission, on a public road, within a public park, or on public land; the same section also lets the Fire Marshal designate places for open fires. The Fire Marshal may post uniform signs or posters at those premises marking where fires may be built and maintained, or where smoking may take place, without any further permit.

Even in a place where smoking is otherwise permitted, the code makes it unlawful to leave or permit to be left any lighted tobacco or burning fire; before leaving, the smoking material or fire must be thoroughly extinguished and covered with mineral earth so it cannot reignite. This is a fire-prevention rule rather than a general public-health smoking ban: it sits in Title 6's fire code chapter and is enforced by the Bureau of Fire Prevention under the County Commission-appointed Fire Marshal, with violations of the fire chapter carrying class B misdemeanor penalties and a separate offense for each day a violation continues.
