040(Z) states: 'Smoking Prohibited. 030 defines 'smoking' broadly for this chapter to cover three things: possessing any lighted or heated tobacco product in any form; inhaling, exhaling, burning or heating a substance containing tobacco or nicotine intended for inhalation through a cigar, e-cigarette, cigarette, pipe or hookah; or using an oral smoking device intended to circumvent the chapter's smoking prohibition, which sweeps in vapes and similar devices along with traditional smoking. ' The only carve-out written into the section is for specially designated smoking areas, which the city sets aside within individual parks; the code does not require the city to provide such an area at every facility. The smoking ban sits directly beside the alcohol ban (subsection Y) and illegal drug ban (subsection X) in the same list of park-conduct prohibitions.
