Orem, UT Public Conduct: Outdoor Smoking Restrictions (2026)

Article 13-1 defines 'smoke or smoking' to include possessing, carrying or holding a lighted pipe, cigar, cigarette or electronic cigarette, as well as actually lighting or exhaling smoke or vapor from any of them, so an e-cigarette user is covered on the same terms as a traditional smoker. The ban is not limited to parks: it reaches all 'city-owned property' as defined for the Article, plus any 'mass gathering,' defined as an outdoor assembly of 25 or more people on city-owned property expected to last at least one hour, such as a concert, festival or rally even outside a designated park.

The single carved-out location in the ordinance is a 10-foot radius around each of two specific benches outside the west entrance of the Fourth District Court building, recognizing that courthouse visitors and staff needed somewhere to smoke on an otherwise city-owned block. Beyond that carve-out, the only other way to smoke legally on city property is for a lessee of City-leased land to obtain an exemption from the Director of the Department of Recreation or a designee, the same mechanism used for the Article's alcohol exemption in 13-1-9.

The current smoking ban was enacted by Ordinance No. O-08-0013 on July 8, 2008; the electronic cigarette language was added later by Ordinance No. O-2015-0026 on August 25, 2015, extending the original tobacco-focused rule to vaping devices.
