Summary

It is unlawful in unincorporated Barrow County to possess an open alcohol container on public streets, sidewalks, rights-of-way, or in any public or semipublic parking lot, per Sec. 6-2(c). The ban extends into vehicles under subsection (g), and licensed establishments must post notice of the rule. County-approved special events and licensed sidewalk cafe patrons are the only carve-outs.

These county ordinances apply to unincorporated areas of Barrow County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)"Open container" defined. The term "open container," as used in this section, means any bottle, can, glass, cup or other vessel which contains an alcoholic beverage not in its original container. ... (c)Possession prohibited in public places and parking facilities. It shall be unlawful for any person to have in his possession any alcoholic beverages in any open container while on the public streets, sidewalks or rights-of-way, or in any public or semipublic parking facility within the county.

Full Breakdown

Sec. 6-2, added by a May 12, 2020 ordinance, defines "open container" broadly to include any vessel holding an alcoholic beverage outside its original container, or an original container whose seal has been broken. Subsection (c) makes it unlawful to possess any alcoholic beverage in an open container on public streets, sidewalks, or rights-of-way, or inside any public or semipublic parking facility, with "semipublic" reaching privately owned lots serving businesses, churches, schools, offices, or multifamily buildings. Subsection (g) separately bans open containers inside a motor vehicle on those same public areas and presumes the container belongs to the driver unless a passenger holds it or it sits in a locked glove box or trunk; subsection (h) exempts limousine, bus, and camper occupants under specific licensing conditions.

Two exemptions apply to subsection (c): county-approved special events under (d), and patrons of a licensed sidewalk cafe under (e), though (f) strips the special-event exemption from anyone inside a vehicle. Subsection (i) requires every licensed alcohol establishment to post a conspicuous notice warning patrons that open containers are barred on public streets, sidewalks, rights-of-way, and public or semipublic parking facilities. Sec. 6-1 clarifies that the whole chapter, including Sec. 6-2, applies only to the unincorporated areas of Barrow County, not the six cities that govern themselves within the county.

Violations & Fines

Sec. 6-2 states no fine of its own, so a violation is punished under the Code's general penalty in Sec. 1-7: a fine up to the maximum state law allows for a county ordinance violation, or imprisonment of up to 60 days, or both, with each day of a continuing violation a separate offense. A licensed establishment that skips the required posted notice under Sec. 6-2(i) faces the same general penalty.

Frequently Asked Questions

Can I carry an open beer on a public sidewalk in unincorporated Barrow County?
No. Sec. 6-2(c) makes it unlawful to have any alcoholic beverage in an open container while on public streets, sidewalks, or rights-of-way, or inside any public or semipublic parking facility within the county. An "open container" includes any vessel without its original seal or one that has already been opened.
Does the open-container law reach private parking lots too?
Yes, if the lot is "semipublic." Sec. 6-2(b) defines that term to include any privately owned parking area where the public may park in connection with a business, church, school, office building, or multifamily residential building, so a shopping-center or church parking lot is covered the same as a public street.
Is it legal to have an open container as a passenger in a car?
Generally no. Sec. 6-2(g) bans open containers in any vehicle on public streets or lots, and presumes the container belongs to the driver unless a passenger is holding it or it's locked in the glove box or trunk. Sec. 6-2(h) carves out limousine, bus, and camper occupants specifically.
Are there exceptions for festivals or licensed sidewalk cafes?
Yes. Sec. 6-2(d) exempts special events approved within the county from the open-container ban, though Sec. 6-2(f) removes that exemption for anyone inside a vehicle at the event. Sec. 6-2(e) separately exempts patrons of a licensed sidewalk cafe from the open-container prohibition while on the cafe's premises.
