Summary

In unincorporated Barrow County, anyone developing land inside the Airport Hazard Overlay District around Barrow County Airport must sign an agreement waiving the right to complain about aircraft noise before planning approval. County Code Section 89-253(b) requires the waiver to run with the land in a recorded deed disclosure and pushes new construction toward extra sound insulation.

These county ordinances apply to unincorporated areas of Barrow County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(b)Airport noise; agreement and waiver of rights. All planning actions will require as a condition of approval that the applicant sign an agreement with Barrow County agreeing that airport noise is likely to increase in the future and that they waive all rights to file formal complaints about airport noise. The agreement shall be evidenced by an Affidavit of Facts Effecting Title recorded in the real estate records of Barrow County. Such Agreement shall at a minimum contain the following provisions: ... (2)All deeds transferring property within the Airport Hazard Overlay Zone shall contain the following: "This property is in an area in the Airport Hazard Overlay Zone and is subject to overflights using the Barrow County Airport. As a result, residents in the Airport Hazard Overlay Zone may be subject to some inconvenience, annoyance or discomfort arising from the noise of such operations. ... and covenant to a waiver of rights to complain about airport noise from normal operations."

Full Breakdown

Barrow County's Unified Development Code addresses aircraft noise through the Airport Hazard Overlay (AHO) District established in article III, division 4, which covers land near the Barrow County Airport (identifier WDR) that lies within the airport's approach zones under section 89-252. Section 89-253(b), titled airport noise; agreement and waiver of rights, makes noise disclosure a condition of development approval rather than a decibel limit: every planning action inside the overlay requires the applicant to sign an agreement with the county acknowledging that airport noise is likely to increase and waiving the right to file formal complaints about it.

That waiver is not just a private contract; the code requires it to be evidenced by an Affidavit of Facts Effecting Title recorded in the Barrow County real estate records, so it runs with the land and binds later buyers. The agreement must also require deeds transferring property in the overlay to carry a standard disclosure paragraph warning that the property is subject to overflights and that residents should expect inconvenience, annoyance or discomfort from normal airport operations. On the construction side, section 89-253(b)(1) pushes buildings in the AHO Zone toward Georgia Power Good Cents insulation standards to cut noise transmission, and any new structure must still meet the separate height restrictions in section 89-405 and the FAR Part 77 airspace limits described in section 89-251.

The AHO District's other restrictions, in section 89-254, add noise-sensitive land use limits, barring uses like schools, hospitals and outdoor theaters from Approach Zones unless the Board of Commissioners grants a special use approval.

Violations & Fines

Developing property in the Airport Hazard Overlay District without recording the required noise waiver and deed disclosure blocks the county from approving the planning action or issuing a building permit under section 89-253. Planning and Community Development enforces the requirement at the permit-review stage, and a deed that omits the disclosure language leaves later buyers without notice, which the county addresses by withholding further approvals until the recorded affidavit is corrected.

Frequently Asked Questions

Does Barrow County limit how loud aircraft can be near the airport?
No decibel limit appears in the Airport Hazard Overlay provisions. Instead, section 89-253(b) requires anyone developing land in the overlay to sign an agreement acknowledging that airport noise is likely to increase and to waive the right to file formal noise complaints, with that waiver recorded against the property.
Do I have to disclose airport noise when I sell property near Barrow County Airport?
Yes. Section 89-253(b)(2) requires deeds transferring property in the Airport Hazard Overlay Zone to include a standard paragraph stating the property is subject to overflights and that residents should expect inconvenience, annoyance or discomfort from normal airport operations.
Are there any building standards meant to reduce aircraft noise inside a home?
Section 89-253(b)(1) says buildings constructed in the Airport Hazard Overlay Zone should at a minimum meet the Georgia Power Good Cents insulation requirements, which are intended to minimize how much aircraft noise reaches the inside of the building.
