(c)No such vehicle shall be occupied for sleeping or as a residence, either permanently or temporarily, when so parked.

Sec. 89-726(b) of the Unified Development Code covers the recreational equipment that Barrow County's growing subdivisions accumulate: travel trailers, recreational vehicles, campers, motorized homes, boats, personal watercraft, wave runners, all-terrain vehicles and trailers of any type. None of these may sit in the front yard, or in any other yard, of a residential lot except as the section itself allows. The allowed locations are narrow: an enclosed garage or carport, or a rear or side yard, and even there the vehicle must stay more than 20 feet from the rear property line and more than ten feet from the side property line.

A boat parked beside the house, nine feet off the side line, still violates the section even though it looks close enough; the setbacks are measured, not estimated. Subsection (c) adds a separate restriction that applies to the same list of vehicles: none of them may be occupied for sleeping or used as a residence, whether permanently or temporarily, while parked under this section, closing off the option of living in a driveway-parked camper. This is a different rule from Sec. 89-726(a)'s ban on wreckers, dump trucks and other commercial equipment in residential districts; a boat or RV is regulated for where it sits, while a commercial truck is banned outright except for agricultural use on AG or AR land.

A Sec. 89-726(b) or (c) violation is a misdemeanor under UDC Sec. 89-1447(a). The magistrate court can impose a civil penalty of up to $2,500.00 for each violation, and each day the RV, boat or trailer remains improperly parked, or occupied as a residence, is a separate offense. The planning and community development director issues the cease-and-desist notice before referral to the sheriff's office.
