Summary

Unincorporated Barrow County treats a dog or other animal that keeps disturbing a neighbor's peace as a noise violation under Code section 58-4(b)(5), but only after the animal's keeper has been formally warned. The complaining neighbor must send written notice by certified mail before a violation can be charged, and once notified, the owner must immediately bring the noise into compliance.

These county ordinances apply to unincorporated areas of Barrow County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(5)Noisy animals or birds. Anyone who keeps or maintains an animal or bird that unreasonably disturbs the comfort or repose of any reasonable person with ordinary sensibilities, because the animal or bird is emitting frequent or long continued sound or noise, and who continues to keep, maintain, or allow any animal or bird to so disturb the comfort or repose of any reasonable person with ordinary sensibilities shall be deemed in violation of this section, provided that the person keeping or maintaining the animal or bird has been first notified in writing by certified mail, return receipt requested, by the complaining party that this animal or bird being kept by the addressee is unreasonably disturbing his or her comfort or repose. ... Upon receipt of a certified letter notifying the person keeping or maintaining such animal or bird, such person shall be required to immediately comply with this section. This section shall not apply to horses, livestock, poultry or other farm animals, provided the sound is emanating from a legitimate farming operation on property that is properly zoned for such use.

Full Breakdown

Barrow County Code § 58-4(b)(5) reaches anyone who keeps or maintains an animal or bird that unreasonably disturbs the comfort or repose of a reasonable person with ordinary sensibilities because it emits frequent or long-continued sound. Unlike most of § 58-4's noise provisions, this one is not self-executing on a single incident: the person keeping the animal must first be notified in writing, by certified mail with return receipt requested, that the animal is unreasonably disturbing the complaining party's comfort or repose. The section is written to be liberally construed, so the notifying neighbor does not need the code's exact wording, only enough detail to inform the owner of the nature of the disturbing noise.

Once that certified letter arrives, the owner shall be required to immediately comply, and continuing to let the animal disturb the neighborhood after that notice is what completes the violation. The subsection carves out a specific exemption: it does not apply to horses, livestock, poultry or other farm animals, provided the sound comes from a legitimate farming operation on properly zoned agricultural property, which matters in a county with as much rural land as Barrow. Because this sits within § 58-4, the article's general definition of noise in § 58-4(a) and its 50-foot audibility presumption still inform how disruptive the sound has to be, even though this specific subsection's own trigger is the certified-mail notice rather than a fixed distance or clock time.

Violations & Fines

Once a keeper has received the certified-mail notice and fails to bring the animal's noise into compliance, the continuing violation is a misdemeanor under § 58-4(e)(2): a fine of $250.00 to $1,000.00, up to 60 days in the county jail, or both, tried in the Magistrate Court of Barrow County under § 58-4(f). Each day the barking or noise continues after notice is its own separate offense under § 58-4(e)(3).

Frequently Asked Questions

Can I report a barking dog to Barrow County right away?
Not as a chargeable violation yet. Section 58-4(b)(5) requires you to first send the dog's keeper written notice by certified mail, return receipt requested, describing the disturbance. Only after that notice arrives and the owner fails to bring the noise into compliance does the ongoing barking become a violation the county can prosecute.
Does the noisy-animal rule apply to farm animals in Barrow County?
No. Section 58-4(b)(5) exempts horses, livestock, poultry and other farm animals as long as the sound comes from a legitimate farming operation on property that is properly zoned for that use, which covers much of the county's agricultural land.
What happens after I send the required certified-mail notice about a noisy dog?
Once the keeper receives the certified letter, § 58-4(b)(5) requires the person to immediately comply, meaning stop the animal from continuing to disturb the neighbor's peace. If the disturbance continues anyway, the keeper can be charged under § 58-4(e)(2), a misdemeanor with a fine of $250.00 to $1,000.00.
