Bolingbrook, IL Public Conduct: Public Alcohol Use (2026)

Village Code Section 6-4 makes it unlawful to consume, offer for consumption, or possess or control any alcoholic liquor in a public place within Bolingbrook unless the container is still original and sealed. The ordinance defines a public place broadly: any public street, public highway, public sidewalk, parking area, or any other place the general public has access to and a right to resort to for business, entertainment or other lawful purposes. That sweeps in village parks, downtown sidewalks, retail parking lots and public rights-of-way, not just streets.

Subsection (c) singles out and prohibits the practice known as brown-bagging, along with bringing your own liquor or BYO drinking, whenever it happens in a public place. The one carve-out is subsection (d): consumption or possession that would otherwise be banned is lawful inside premises that hold a liquor license under chapter 6, or during a group function for which a license has been obtained under that chapter, such as a permitted event at a banquet hall or a licensed outdoor festival. 00 for each offense, with a separate offense deemed committed for each day a violation occurs or continues.

Because Bolingbrook is a home rule municipality under Article VII, Section 6(a) of the Illinois Constitution, this local ban stands independent of the state Liquor Control Act, which the village separately adopts by reference in section 6-1.
