Bolingbrook, IL Public Conduct: Public Marijuana Use (2026)

Section 36-553, Unlawful use of cannabis, Public place, makes it unlawful for any person to use cannabis in any public place within the village, a stand-alone one-sentence prohibition in Chapter 36's Division 3 (Cannabis). It sits alongside a cluster of related bans adopted the same day: Sec. 36-551 bars using cannabis inside the passenger area of a vehicle on a village street, Sec. 36-552 bars possessing it in a vehicle unless sealed in an odor-proof, child-resistant container, Sec. 36-554 bars use in close physical proximity to anyone under 21, Sec.

36-555 bars use on any property, including village-owned land and parking areas, without the property owner's permission, and Sec. 36-556 bars smoking cannabis anywhere smoking is already prohibited under the state Smoke Free Illinois Act. All of these were added by Ordinance No. 16-080 on September 13, 2016, and amended by Ordinance No. 19-094 on December 17, 2019, aligning village code with the state's Cannabis Regulation and Tax Act, which lets home rule municipalities like Bolingbrook regulate time, place and manner even though possession itself is state-legal for adults 21 and over.
