North Carolina prohibits possessing an open alcohol container on most public streets and sidewalks under NCGS 18B-300, with violations charged by CMPD. The 2021 General Assembly enacted NCGS 18B-904.1 authorizing municipalities to designate Social Districts where adults 21+ may carry properly labeled cups of beer, wine, or spirits between participating ABC permittees during posted hours. Charlotte has approved districts including Uptown, South End, NoDa, and Plaza Midwood. Drinks must be in district-marked cups, consumed within posted boundaries, and not taken into other businesses. Glass containers, kegs, and BYO alcohol remain prohibited.
Open beer cans on a sidewalk outside a Social District, glass cups, BYO alcohol, drinking past district hours, or carrying cups from non-participating bars triggers CMPD citations and possible ABC license action.
