230 of Elizabeth's litter control chapter prohibits drinking, imbibing or consuming any alcoholic beverage on a public street, lane, roadway, avenue, sidewalk, public parking place, park, playground or recreational area, or any other public place; inside a public conveyance such as a bus; inside a private vehicle that is in motion or parked on a public street, lot or place; or on private property that is not the drinker's own, without the owner's express permission. 240 separately bars discarding alcoholic beverage containers, cans or bottles in those same public places or on someone else's private property without permission, an open-container rule that covers empties even after the drinking itself has stopped.

250 makes anyone who violates either section a disorderly person under city law, not merely a code violator. 270 routes the permit application through the Elizabeth recreation department. Absent that kind of event permit, the ban applies citywide, around the clock, to any public street, park or parking lot, and to private vehicles even when legally parked. The chapter's enforcement falls to the Elizabeth police department, and because the offense is a disorderly-persons violation rather than a simple ordinance infraction, it is prosecuted in Elizabeth municipal court.
