Full Breakdown
Section 4-313(a) makes it unlawful to drink or possess an open container within the property lines of any store licensed only for package sales, or within 200 feet of its entrance, whichever distance is shorter. Subsection (b) then bans drinking or holding an open container on any public street, highway, alley, sidewalk, park or picnic area countywide. Subsection (c) carves out specific exceptions: passengers (not drivers) in vehicles on public streets, licensed sidewalk cafes, functions run by a bona fide nonprofit civic organization holding an alcohol license, mayor-approved giveaway events, and structured downtown drinking windows.
One of those windows lets a nonprofit-sponsored event in the defined downtown business area, bounded by Martin Luther King Jr. if alcohol comes from a participating licensed business, is served in an approved cup, and the drinker wears an approved wristband. under commission-set conditions. with alcohol limited to cups, plastic bottles and cans (glass containers stay illegal even inside the zone), and a similar window covers designated game days at Luther Williams Park and the Softball Complex. Section 4-312 separately authorizes brown bagging permits letting patrons bring their own alcohol into licensed on-premises establishments, a related but distinct authorization from the open-container ban in Section 4-313.
Violations & Fines
Violating Section 4-313 is a citable offense enforced by Macon-Bibb County law enforcement, including the Office of the Sheriff, which also polices the county's alcohol licensing chapter generally. A participating downtown business that knowingly lets a patron leave with a drink not in an approved cup or without an approved wristband is itself in violation of the section under subsections (c)(5)d and (c)(6)d, independent of any citation issued to the patron carrying the open container.
