Waynesville City Park is the one place written out of the prohibition. Violators face up to a $500 fine or 90 days in jail.
For purposes of this Section, the term "public place" shall mean any public street, highway, alley, sidewalk, thoroughfare or other public way of the City, or any parking lot. No person shall drink or ingest any intoxicating liquor in or on any public place. No person shall possess or have under his/her control any unsealed glass, bottle, can or other open container of any type containing any intoxicating liquor while in or upon any public place. No person shall possess or have under his/her control any unsealed glass, bottle, can or other open container of any type containing any intoxicating liquor while within or on any motor vehicle while the same is being operated upon, or parked or standing in or upon, any public place. ... The Waynesville City Park will not be included in this prohibition. ... Any person violating any of the provisions of this Chapter shall, upon conviction, be punished by a fine of not more than five hundred dollars ($500.00) or by imprisonment for a term not exceeding ninety (90) days, or both such fine and confinement.
Full Breakdown
Section 720.110 of the Waynesville Municipal Code defines a public place broadly, as any public street, highway, alley, sidewalk, thoroughfare or other public way of the City, or any parking lot, and then bans two separate things there: drinking or ingesting any intoxicating liquor, and simply possessing or controlling an unsealed glass, bottle, can or other open container of intoxicating liquor. The open-container rule follows a person into a vehicle: no one may possess an unsealed container in or on a motor vehicle while it is being operated, parked or standing in a public place, and the ordinance goes further by presuming that whoever is operating the vehicle is in possession of any open container inside it, whether or not they are physically holding it.
That presumption puts the burden on a driver to show an open container in the car is not theirs to control. The section carves out exactly one location: the Waynesville City Park is not covered by this public-place prohibition, so alcohol consumption there is governed by the City's other Chapter 720 rules rather than the open-container ban. The overall Chapter 720 penalty in Section 720.140 applies here, since Section 720.110 sets its own violations under the heading Miscellaneous Offenses without a separate penalty clause of its own.
Violations & Fines
Section 720.140 sets the penalty for violating any part of Chapter 720, including the open-container and public-drinking rules in Section 720.110: a fine of not more than $500, imprisonment for up to 90 days, or both. A first offense does not automatically trigger a City Administrator review, but a second or later violation is reviewed by the City Administrator for additional administrative action beyond whatever a court orders.
