Summary

Wilmington City Code § 6-12 bars drinking malt beverages or unfortified wine on any public street, sidewalk or city-owned property, bars pedestrians from carrying an open container of them, and separately bars consuming any alcoholic beverage at all on city-owned property. Subsection (b) makes it unlawful, absent specific city council permission, to consume a malt beverage or unfortified wine on any public street, road, highway, sidewalk, right-of-way, alley, facility or other city-owned or occupied property; for a pedestrian to possess an open container of either on that same public property; or for anyone to possess a malt beverage or unfortified wine on a street, sidewalk, alley, lot or right-of-way temporarily closed for a special event.

Subsection (c) goes further for property the city owns or occupies: no alcoholic beverage of any kind, not just malt beverage or wine, may be consumed there without council permission. It is also unlawful to aid, abet, counsel or induce anyone else to violate the section. "
