Summary

Charleston makes it a crime to sell, possess, use or transport one ounce or less of marijuana or ten grams or less of hashish anywhere within city limits, public or private. City Code § 21-126(a) carries no location exception, so smoking or holding marijuana in a park, on a sidewalk or at an event is enforced the same as private possession, on top of separate state marijuana law.

(a)No person shall sell, offer for sale, give away, bargain, trade, distribute in any manner, transport, use, prescribe, possess, knowingly keep, conceal or allow on premises under his control one ounce or less of marijuana or ten (10) grams or less of hashish.

Full Breakdown

City Code § 21-126, part of Chapter 21's Article VI offenses against public health, prohibits selling, offering for sale, giving away, bargaining, trading, distributing, transporting, using, prescribing, possessing, knowingly keeping, concealing or allowing on premises under one's control one ounce or less of marijuana or ten grams or less of hashish. The section sets its own misdemeanor penalty, a fine up to $100 or up to 30 days in jail, only for subsection (b), which separately bans inhaling aromatic hydrocarbon fumes to get intoxicated; subsection (a)'s marijuana and hashish prohibition carries no stated penalty of its own, so it falls back to the Code's general penalty at § 1-16, a fine up to $500 or up to 30 days in jail, with each day of a continuing violation charged as a separate offense.

Because the ordinance is not limited to any location, the Charleston Police Department applies it the same way to marijuana smoked or held in a public park, on King Street, at a festival, or on private property; there is no carve-out for outdoor or public consumption. The adjoining § 21-127 separately bans possessing or selling paraphernalia used to ingest, smoke or prepare marijuana, hashish, hashish oil or cocaine. Both sections operate alongside, not instead of, South Carolina's own marijuana possession statutes, which carry their own separate state penalties.

Violations & Fines

Marijuana or hashish possession or use under § 21-126(a) is a misdemeanor punished under the Code's general penalty, § 1-16: a fine up to $500 or up to 30 days in jail, with each day a continuing violation persists charged as a separate offense. Related paraphernalia offenses under § 21-127 are punished the same way.

Frequently Asked Questions

Is it legal to smoke marijuana in a Charleston park?
No. City Code § 21-126(a) bans using, possessing or transporting one ounce or less of marijuana anywhere in the city, including parks and other public places; it carries no exception for outdoor or public use.
What is the penalty for marijuana possession in Charleston?
Section 21-126(a) sets no penalty of its own, so the Code's general penalty under § 1-16 applies: a fine up to $500 or up to 30 days in jail, separate from any charge under South Carolina's state marijuana laws.
Does the ordinance also cover paraphernalia?
Yes. City Code § 21-127 separately bans selling, delivering or possessing paraphernalia used to ingest, smoke, administer or prepare marijuana, hashish, hashish oil or cocaine, with cigarette papers and tobacco pipes excluded.
