Cicero, IL Public Conduct: Public Marijuana Use (2026)

Section 62-25, 'Cannabis control,' declares in subsection (b) that 'it shall be a violation of this section for any person to manufacture, deliver or possess any quantity of any substance containing cannabis' within the Town of Cicero. The section defines cannabis expansively to include 'marihuana, hashish and other substances which are identified as including any parts of the plant Cannabis sativa,' along with tetrahydrocannabinol (THC) and other cannabinol derivatives, while excluding sterilized seed, mature stalks, and fiber or oil made from stalks. Subsection (c) carves out a narrow exemption for 'persons authorized to possess, produce, manufacture and deliver any substances containing cannabis for research purposes as permitted in 720 ILCS 550/11,' the state Cannabis Control Act's research provision.

' The ordinance dates to 1978 and was last amended by Ordinance No. 264-03 on December 9, 2003, before Illinois legalized recreational cannabis for adults in 2020; the local text has not been repealed or narrowed to track that change, so the town code as published still reads as a blanket local possession ban layered on top of state law. The Cicero Police Department is the enforcing agency for the local charge, which can be brought in addition to any state charge arising from the same conduct.
