Fort Wayne, IN Public Conduct: Public Marijuana Use (2026)

City Code § 95.60 defines SMOKING as inhaling, exhaling, burning, or carrying any lighted or heated tobacco or cannabis product, including vaping devices. Section 95.62 then bans smoking in all enclosed public places within Fort Wayne, restaurants, bars, offices, retail stores, and city buildings, with narrow exceptions for licensed cigar lounges, retail tobacco stores, and certain hotel and nursing-home rooms. Because the definition folds cannabis into 'smoking,' consuming marijuana indoors anywhere the public is admitted is enforced the same way as a cigarette violation, on top of whatever state marijuana-possession charge applies.
