The ban also covers any street, sidewalk, public way, footway, passageway, stairs, bridge, park, playground, beach, recreation area, boat landing, pond, lake, river, waterway, public building, schoolhouse, school grounds, cemetery, parking lot, parking garage, or other area owned or controlled by the City, any bus or passenger conveyance run by a common carrier, and any place accessible to the public generally, tracking the state public-smoking framework in MGL c.
270, § 22. A companion rule, § 318-2, separately requires that any marijuana, THC, or cannabinoid product kept or cultivated for personal use be secured in a locked container, with plants grown for personal use kept in a locked enclosed area. Enforcement runs through § 318-3: the Mayor, Council, their agents, or any police officer may pursue a criminal complaint under MGL c. 40, § 21, or use the noncriminal disposition process under MGL c. 40, § 21D, and the fine is $300 for each offense, layered on top of, not instead of, any civil penalty available under MGL c. 94C, § 32L.
