Recreational marijuana remains illegal in Mississippi. Even Mississippi Medical Cannabis Act patients cannot consume in public. Jackson police arrest for possession in public, and consumption in vehicles or parks is a misdemeanor.
Mississippi voters approved medical cannabis through Initiative 65 (2020), later codified as the Mississippi Medical Cannabis Act after MS HB 1547 (2022). Recreational marijuana remains a controlled substance. Even registered medical patients may consume only in a private residence; smoking, vaping, or eating cannabis products in public, in a parked vehicle, or in any city park or sidewalk is prohibited under MS Β§41-137-29 and Jackson Code Chapter 86. Possession of 30 grams or less for non-patients is decriminalized statewide to a $250 civil fine on first offense, but Jackson officers retain arrest discretion for visible public use. Jackson State University remains drug-free as a federally funded campus.
Public consumption is a misdemeanor: fine up to $1,000 and possible 90 days in jail under MS Β§41-137-29. Non-patient possession over 30g escalates to felony charges. Consumption in a vehicle adds DUI exposure under MS Β§63-11-30.
