Palatine, IL Public Conduct: Public Marijuana Use (2026)

Village Code § 22-142 sits in chapter 22's Article V, 'Offenses Involving Morals,' between the public indecency ban (§ 22-141) and the sale of drug paraphernalia section (§ 22-143). It tells residents and visitors in the Village of Palatine that growing, using, possessing or consuming cannabis is unlawful the moment it departs from what the Illinois Cannabis Control Act or Cannabis Regulation and Tax Act permits, which caps lawful cannabis use to private property and away from public view. The Village Council has amended the section repeatedly to track state cannabis law: Ord.

No. O-37-76 first codified it in 1976, Ord. No. O-103-19 (Dec. 2, 2019) updated it for statewide adult-use legalization, and Ord. No. O-36-26, § 1(Exh. A) (Apr. 13, 2026) is the most recent revision folding the cannabis provision into the Village of Palatine's newly recodified Code of Ordinances. Rather than fix a dollar figure in the text, § 22-142(b) points violators to whatever amount the village fine schedule sets for the offense, so the Palatine Police Department applies the current schedule when writing a citation.

The neighboring drug paraphernalia section, § 22-145, was amended by the same 2026 ordinance and separately bans selling, delivering or possessing pipes, bongs, and similar items tied to cannabis or controlled-substance use, with its own fine-schedule penalty and forfeiture provisions administered by the chief of police. Because Palatine is a home rule village, its council sets penalties independent of the state acts it cross-references; officers responding to a complaint downtown, at Towne Square, on the Metra platform, or in a park apply § 22-142 directly.
