Palatine, IL Public Conduct: Public Alcohol Use (2026)

Village Code § 22-76 makes it unlawful for anyone in the Village of Palatine to possess an alcoholic beverage on a public street or in a public place unless the beverage is in its original container with the manufacturer's seal unbroken, or unless the possession happens on the premises of a business the village has licensed to sell or serve alcohol. The ordinance defines 'public place' broadly to include every village-owned parking facility and lot, plus any parking lot serving a commercial establishment or a multifamily residential development of four or more dwelling units.

The statute goes further than streets and parking lots: it also bars possessing an open alcoholic beverage in a common area of a property owners' association, an apartment complex, or a common element of a condominium (as defined by the Illinois Condominium Property Act, 765 ILCS 605/2(e)) serving a development of four or more units, covering parking lots, sidewalks, grass and open-space areas, detention areas, stairways, hallways and storage rooms, though patios and balconies are excluded from that common-area ban, as is the interior of a residential unit.

A property owner, manager or owners' association can ask the village council to approve consumption in a defined area of the property, and the council has discretion to grant that request. Palatine's police department enforces § 22-76 as part of Chapter 22's offenses and miscellaneous provisions, and § 22-234 sets the penalty for chapter violations generally: a fine set by ordinance or resolution of the village council, plus the cost of any village abatement, for each violation.
