Oak Park, IL Public Conduct: Public Alcohol Use (2026)

Oak Park Village Code § 17-1-31, adopted by Ordinance 1981-0-69 on October 5, 1981, makes it unlawful for any person to drink any alcoholic liquor, as defined by Illinois law, on any public street, parkway or sidewalk within the Village. The prohibition covers the full width of the public right of way, not just roadways, so drinking while standing on a parkway strip or a public sidewalk in downtown Oak Park, along Lake Street, or in a residential block is covered exactly the same as drinking in a traffic lane.

The section carves out a single exception: streets that have been closed to vehicular traffic in connection with a block party or similar event. Oak Park routinely permits block parties, and once the Village closes a street for one, residents attending that specific closed-street gathering may drink there without violating this section. Outside of a permitted closure, the ban applies at all times of day and on any day of the week; there is no nighttime-only or weekend carve-out in the text. 00 per violation, with each day a violation continues charged as a separate offense.

Oak Park police officers issue citations for open-container violations under this section on the spot, and enforcement is common downtown and along Chicago Avenue and Lake Street where sidewalk foot traffic is heaviest, particularly around bars and restaurants that do not hold outdoor liquor service permits.
