Parker, CO Public Conduct: Public Marijuana Use (2026)

Section 8.08.060(a) makes it unlawful to display, consume or use marijuana, as marijuana is defined in § 8.08.030(a), in any public place as defined in § 8.01.010(b), or upon property owned, operated, leased or maintained by the State or the Town. Because public place under § 8.01.010(b) excludes the interior or enclosed yard of a private home, residence, condominium or apartment, the ban targets outdoor use on streets, sidewalks, parks and other government property rather than use inside one's own residence. Marijuana is defined in § 8.08.030(a) to cover all parts of the cannabis plant and its resin, concentrate, derivatives and preparations, while excluding industrial hemp and sterilized, non-germinating seed.

Subsection (b) sets its own penalty, a fine of not more than $100.00 upon conviction, plea of guilty or plea of no contest, which is lower than and independent of the $25.00 to $1,000.00 range that applies by default to most other Title 8 offenses under § 8.01.040. The Section was last amended by Ordinance 5.72.1 in 2020, updating the Town's earlier 2012 marijuana ordinance to track the state's adult-use legalization framework while still barring public display and consumption. Parker Police Department officers enforce the ban, and cases proceed in Parker Municipal Court under this Section's own fine cap rather than the Town's general Title 8 penalty scale.
